Why do I need an Influencer Agreement?
Influencer marketing is increasingly popular to grow a customer base and build brand awareness. However, a verbal or unclear arrangement could be disastrous for your brand financially and reputationally if things go wrong. Think misunderstandings re keeping expensive designer garments, use of competitor or off-brand imaging, offensive content, and disputes regarding how fees should be calculated. Our Influencer Agreement ensures everyone is on the same page about content creation expectations, fees, intellectual property ownership, deliverables and deadlines.
Who is an Influencer Agreement for?
Brand owners, marketers, and advertisers engaging an influencer to promote their products or services through social networks.
What’s in this Influencer Agreement?
NZ lawyers have created this agreement to be used by NZ businesses. It is simple, easy to understand, without legalese and fair to both sides to reduce negotiation time and keep the relationship positive.
The agreement is easy to tailor to each collaboration. It can be used for a one-off specific campaign or ongoing engagement for multiple campaigns (when used with our Campaign Brief to Influencer Agreement). It enables you to create a detailed scope for the collaboration (by answering some simple questions). It includes clear payment terms (you can choose from fixed fee, commission per sale, fee per post, bonuses for meeting targets), intellectual property protection and optional exclusivity and non-competition restraints. The influencer is required to comply with your brand guidelines, applicable laws and the Advertising Standards Codes and guidelines.
How long will it take to create my Influencer Agreement?
10-15 minutes – do it over your next coffee! During the Q&A you can save your progress to come back later, or repeat the Q&A to change an answer or produce a new version of a document.
What information do I need to complete the Q&A?
- The name and contact details of the brand owner and the influencer
- Campaign details – one-off or ongoing engagement? Duration?
- Content - specific platforms, type of content, number of posts, required tags and items to avoid, timing, visibility, republishing rights
- Type of fees, expenses and method of payment
- The duration and area of any non-competition and non-solicitation restraints
